Durable Power of Attorney
A durable power of attorney allows you to designate an individual to make legal and financial decisions on your behalf. A power of attorney can be put into effect immediately, or can be effective upon your incapacity. Pabian & Russell will advise you on how to choose an agent and how best to draft the durable power of attorney to ensure that your assets are properly managed in the event that you are unable to manage them yourself.
Health Care Proxy
A health care proxy is also known as a medical power of attorney. This instrument will give your agent the authority to make health care decisions for you in the event you are unable to make these decisions for yourself.
A living will, also known as an advanced healthcare directive, is an important legal document that provides your loved ones with instructions regarding your medical wishes if you were to become gravely ill. A living will relieve your family of the burden of making difficult decisions about your medical care at the end of your life. While Massachusetts does not recognize living wills, it can provide the agent designated in your health care proxy with evidence of your wishes.
The Health Insurance Portability and Accountability Act (HIPAA) of 1996 protects the privacy of your health information and makes it very difficult for anyone other than you to access your medical information. A HIPAA Authorization will allow your designated agent access to your medical records.
