Nursing Home Resident Rights

medicaid planningNursing home residents are granted specific rights and protections under federal law including rights addressing medical care and respect, services and fees, privacy and money management. Patient rights usually include the following:

  • The right to be treated with dignity and respect
  • The right to be informed in writing about services and fees before entering the home
  • The right to manage your own money and finances, or to choose someone else to do this for you
  • The right to privacy, and the right to keep and use personal property as long as it doesn't interfere with the rights, health or safety of others
  • The right to be informed of your medical condition and medications, and to see your own doctor
  • The right to refuse treatments and medications

Nursing home laws require nursing homes to provide all new residents a copy of these rights prior to their admittance. Pabian & Russell's elder law attorneys can clearly explain these rights to you or your loved one, and we stand ready to protect and defend your interests.

Guarding Against Nursing Home Abuse & Neglect

Unfortunately, too many seniors suffer nursing home abuse and neglect at the hands of overworked or improperly trained staff. Seniors may become ill or injured due to unclean conditions, poor diet and lack of proper supervision.

Occasionally, nursing home administrators forget that residents of nursing homes and long-term care facilities are protected by the same civil and personal rights they enjoy. If you have any reason to suspect that your elderly or disabled loved one is being abused or neglected, please call us immediately. Our skilled attorneys will advise you on the law, and can assign a nursing home neglect specialist to investigate your concerns. Pabian & Russell is firmly committed to protecting every elderly or disabled client against abuse or neglect.
